Terms of Service

1. Acceptance of Terms

By accessing or using the Paladin gaming safety platform (the "Service") operated by MBJR Creative, LLC ("Paladin," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

  • You must be at least 18 years old to create an account.
  • You must be the parent or legal guardian of any child whose gaming activity you monitor through the Service.
  • You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction, including laws related to monitoring minors' electronic communications.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must complete COPPA-compliant parental verification before monitoring begins.
  • You may not share your account or allow others to access it.
  • You must notify us immediately of any unauthorized use of your account.

4. Description of Service

Paladin provides:

  • Windows Agent: Software installed on a child's Windows PC that monitors gaming activity, captures in-game text communications, and enforces screen time rules.
  • AI Classification: Cloud-based artificial intelligence that analyzes captured communications for potential safety threats including cyberbullying, predatory behavior, self-harm indicators, and other harmful content.
  • Parent Dashboard: A web application where parents view safety alerts, configure monitoring settings, manage screen time rules, and access AI-generated context and recommendations.

5. Monitoring Limitations

You acknowledge and agree that the Service has inherent limitations:

  • The AI classification system may produce false positives (flagging safe content) or false negatives (missing harmful content). The Service is not a substitute for active parental involvement.
  • Text capture effectiveness varies by game. Some games use proprietary chat systems that may not be fully accessible to the agent.
  • Screen time enforcement relies on process-level controls. A technically sophisticated child may find ways to circumvent monitoring.
  • The Service monitors only the specific Windows PC where the agent is installed. It does not monitor mobile devices, consoles, or other computers.
  • Real-time alerts depend on internet connectivity. If the child's PC loses internet access, monitoring data will be queued and uploaded when connectivity is restored.

6. Subscription and Billing

6.1 Free Trial

New accounts receive a 14-day free trial with full access to all features. A credit card is required during setup to verify parental identity under COPPA: we place a temporary $0.50 authorization and release it without capturing it, so you are not charged and no subscription begins. Billing details are collected separately when you choose a plan. At the end of the trial, monitoring will pause until you subscribe.

6.2 Subscription Plans

  • Monthly: $9.99 per month, billed monthly.
  • Annual: $89.99 per year, billed annually (~25% savings).

6.3 Billing

  • All payments are processed securely through Stripe.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • If payment fails, your account enters a grace period. Monitoring continues for 7 days while we attempt to process payment. After 7 days, monitoring pauses until payment is resolved.

6.4 Cancellation and Refunds

  • You may cancel your subscription at any time through the billing settings in the dashboard or by contacting support.
  • Cancellation takes effect at the end of the current billing period. You retain access to the Service until then.
  • Refunds are available within 30 days of purchase for annual subscriptions if you are not satisfied. Monthly subscriptions are non-refundable.

7. Acceptable Use

You agree not to:

  • Use the Service to monitor any person who is not your minor child or ward
  • Reverse-engineer, decompile, or disassemble the Paladin Windows Agent
  • Attempt to circumvent any security measures or access controls of the Service
  • Use the Service for any unlawful purpose
  • Redistribute, sublicense, or resell access to the Service
  • Use the Service in any way that could harm, disable, or impair our infrastructure

8. Intellectual Property

The Service, including all software, content, designs, and documentation, is owned by MBJR Creative, LLC and protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE THAT THE AI CLASSIFICATION SYSTEM WILL DETECT ALL THREATS OR THAT ALL ALERTS WILL BE ACCURATE.

PALADIN IS A SUPPLEMENTARY TOOL TO ASSIST PARENTS AND IS NOT A SUBSTITUTE FOR ACTIVE PARENTAL SUPERVISION AND ENGAGEMENT WITH YOUR CHILD ABOUT ONLINE SAFETY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALADIN SECURITY INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, EMOTIONAL DISTRESS, OR FAILURE TO DETECT A SAFETY THREAT.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless MBJR Creative, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. Arbitration shall take place in St. Johns County, Florida. You agree to waive your right to a jury trial and to participate in a class action.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14. Modifications to Terms

We may modify these Terms at any time. We will provide notice of material changes via email to your registered account at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

15. Termination

  • You may terminate your account at any time by deleting your account through the dashboard settings.
  • We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or if we reasonably believe your use poses a risk to our Service or other users.
  • Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

16. General Provisions

  • Governing Law: These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Paladin regarding the Service.
  • No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
